General Terms and Conditions

These General Terms and Conditions should be read in conjunction with the Privacy Policy, listed separately on our website, and the Studio Etiquette displayed in the studio premises at 54 New Street, Worcester, WR1 2DL. 

In these documents, “The Zen Shed”, “us “ or “the company” or “the studio” refers to Ndoro Wellness Limited (trading as The Zen Shed), “our website” or “the site” refers to the website and related apps operated by thezenshed.com.

These terms and conditions are governed by the Laws of England and the parties submit to the jurisdiction of the Courts of England and Wales.

Use of the Website and the Studio

The Zen Shed website is comprised of various web pages operated by The Zen Shed. On entering The Zen Shed website and/or The Zen Shed studio at 54 New Street, Worcester, WR1 2DL, you agree to be bound by these General Terms and Conditions, in conjunction with the other documents referred to above.

Becoming a Zen Shed Student, Booking Classes, Cancellations and Refunds

Once you complete and submit the online registration form, sign the liability waiver and make the necessary class payment, you will become a Zen Shed student, and will be able to book classes online on our website, or at the studio reception. In regard to online bookings you are referred to the specific policies set out in our Online Bookings Policy below regarding signing in for classes and our policy on refunds and cancellations. Bookings for drop in classes must be made at least 15 minutes prior to the scheduled class time, or may not be accepted.

No refunds will be given for classes outstanding on a class card that are unused, or in relation to any time remaining on a monthly or annual membership card that has still to elapse. Refunds for other goods and services will not be given other that as stated in the Online Booking Policy, Workshop Policy and Teacher Training Terms and Conditions.  

Refunds for physical items purchased at the studio will only be given if the goods are returned still within the original, unopened packaging and along with the original receipt as proof of purchase. This does not affect your statutory rights.

Online Booking Policy

  • When you book online, you must be at the studio in plenty of time to sign in to the class.  We advise you arrive at reception at least 10 minutes before the scheduled class starting time.  If you have not checked in 5 minutes before, we may reallocate your place and we cannot guarantee you will be admitted to the class.  In this case, this will be treated as a late cancellation and no refund will be given.

  • If you can’t attend a class you have booked online please cancel the class as soon as possible so that your spot can be taken by someone else.  Cancellations can only be processed online.  We do not have the facility to process cancellations over the phone or at studio reception.  A cancellation within 4 hours of the scheduled class start time will be considered a late cancellation and no refunds will be given.

  • If you no-show or cancel late for two classes within a 14 day period, we reserve the right to suspend your ability to book online.  Classes can get full and we want everyone to have the maximum chance of getting into the class they want to attend.

  • Payment for classes will be taken at the point of booking online using your debit or credit card. If you have a Zen 8 or Zen 4 membership or a multiple class pass, we will deduct the class from your pass at the time of booking.

  • Every class has a maximum number of places which can be booked in advance online.  If the class is full you will have the opportunity to be placed onto a waitlist, for which you will not be charged.  Should a place become available, we will advise people on the wait list by email, and the spaces which have become available will be allocated on a strict first come, first serve basis. If you are on a waitlist please check your email regularly to see if you have been allocated a space.

  • It is only possible to book for the 30 day cycle for which payment has been taken; if you are unable to book a class, it is usually because the class is falling within the next payment cycle and you will need to wait until that payment has been taken 

  • The Zen Shed cannot guarantee that by paying for a pass, there will always be space available in any particular class.

  • We reserve the right to make changes to our schedule which includes a reduced schedule during school holidays; wherever possible changes such as teacher substitutions, cancelled classes, time changes, holiday closures, etc, will be reflected on our online schedule. 

 

New Student Offer

From time to time The Zen Shed will offer packages to new students. These introductory offers are restricted to NEW STUDENTS who are setting up an account with The Zen Shed for the first time. It is a one-time offer only. The offer activates on the date of your first class and is valid for a number of consecutive days. It includes all our regular yoga classes with the exception of aerial yoga, prenatal yoga and dog yoga. Workshops and special events are not included.  We reserve the right to take booking privileges away from anyone who no shows or late cancels more than once on their introductory pass.

Zen Shed Members

All membership contracts are subject to terms and conditions applicable to the level of membership purchased.  Please refer to specific terms for Zen 4, Zen 8 and Zen Full memberships at the end of this document.

Workshop Policy

Payment for workshops will be taken at the point of booking online using your debit or credit card.  Unfortunately we do not accept American Express.

In the event that you can no longer attend a workshop, a refund (minus a 10% + VAT admin fee) will be made for cancellations made more than 28 days before the start date. For cancellations less than 28 days before the workshop there will be no refunds or transfers unless:

  • the workshop is full and your place can be filled from a waiting list, or 

  • you are sick/injured/pregnant and can provide a doctor’s note

In these cases we will refund the fee, minus a 20% + VAT admin fee.

Refunds may not be claimed retrospectively. If we have not heard from you 24 hours before the commencement of a workshop we will not be able to process any refunds under any circumstances.

All clients are asked to agree to The Zen Shed Terms and Conditions upon booking a course or workshop.

We reserve the right to cancel a workshop for any reason. We would only do this in exceptional circumstances that mean we are unable to offer the workshop as advertised, or if there are insufficient numbers booked onto the workshop to make it viable for the teacher taking the workshop. Should this happen, we will notify you as soon as we have knowledge of the cancellation and will refund you the full £ (sterling) amount you have paid us in respect of the workshop. We will not be responsible for any additional expenses which you may have incurred in respect of the workshop, including travel, accommodation or exchange rate losses.

 

Access to and use of Studio Facilities

The studio is open 30 minutes before the first class each morning and evening, and closes 15 minutes after the last class each morning and evening. Class times are published on the website. Every effort will be made to ensure the studio is accessible to members and other guests at those times. The studio will not however accept any liability if, for any reason, the studio is not open or accessible during the planned opening times.

The studio will make every effort to ensure that classes run according to the published schedule, and that the teacher taking the class is as advertised on the website. In the event that a class is unavoidably cancelled, refunds will be given to any member who has made an online booking on the same basis as if a cancellation request had been received in good time from that member. 

The studio reserves the right to bar or expel any member, guest or other person from the studio premises at its absolute discretion, where the conduct of that person is felt to be antisocial, impinges upon the good name and brand of the studio and The Zen Shed, interferes with the enjoyment of the facilities by other members or guests or in any other way amounts to a breach of these Terms and Conditions. Aggressive, abusive or threatening behavior towards any member of studio staff will not be tolerated under any circumstances.

Any personal belongings are brought onto the studio premises at the member’s own risk and the studio does not accept liability for theft, loss or damage of any such items. Secure lockers are available in the changing rooms at no charge.

Health and Medical

We will also ask you to complete a Registration Form when you sign up which includes health and medical questions in order that we can be aware of any matters that are relevant to you and your yoga, or meditation, practice. You should however be aware that we are not a registered medical clinic and we do not employ registered medical practitioners and the exercises offered are not a substitute for medical expertise.

Yoga and associated practices involve physical and mental exercises, which may be strenuous, and we strongly recommend that you seek advice from your doctor before commencing any exercise routine or practice to ensure that it is suitable for you. If you feel discomfort or pain, DO NOT continue. The Zen Shed disclaims any liability or loss arising in connection with any exercises or practices promoted by or taught at the studio.

The studio reserves the right to refuse access to any member if it considers that the health of the individual may be put at risk by the use of the studio facilities. Notwithstanding this, it remains the member’s sole responsibility to ensure that any classes or therapies he/she chooses to attend are suitable for them.

Safety Considerations

Members and their guests should make themselves aware of all fire exits and other fire precautions within the studio. In case of an emergency, the instructions of the studio staff must be followed.

Glassware and food for consumption are not allowed in the studio, and smoking and vaping are strictly prohibited on the studio premises.

Members and guests should be considerate of other members, guests and staff in all matters of health and hygiene, and are asked to wear appropriate foot coverings if they have an infectious or transmittable foot condition.

Children

Children under the age of 16 are not allowed to practice in the studio, unless accompanied by a responsible adult, and only after that responsible adult has confirmed with the teacher that the class is suitable for a child to practice. 

We do not recommend children under 10 practice in our scheduled classes.  Specialist children’s yoga and family yoga classes are run from time to time which will be more suitable.  Under no circumstances will anyone under the age of 16 be allowed to join a Hot Yoga class.

Children under the age of 16 should not be left unattended on the studio premises, and over the age of 7 children may not enter the changing rooms reserved for the opposite sex.

Animals

Other than guide dogs and assistance dogs, no animals are allowed on the studio premises without prior written permission from the studio.

Modifications of these Terms and Conditions

The Zen Shed reserves the right to change the terms and conditions and notices under which The Zen Shed website and studio facilities are offered, including but not limited to charges associated with the use of The Zen Shed website.

Links to Third Party Sites

The Zen Shed website may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of The Zen Shed and The Zen Shed is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The Zen Shed is not responsible for webcasting or any other form of transmission received from any Linked Site. The Zen Shed is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by The Zen Shed of the site or any association with its operators.

No Unlawful or Prohibited use of The Zen Shed Website

As a condition of your use of The Zen Shed website, you warrant to The Zen Shed that you will not use The Zen Shed website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use The Zen Shed website in any manner which could damage, disable, overburden, or impair The Zen Shed website or interfere with any other party's use and enjoyment of The Zen Shed website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through The Zen Shed website.

Use of Communications Services 

The Zen Shed website may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, social media and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.

  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.

  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.

  • Conduct or forward surveys, contests, pyramid schemes or chain letters.

  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.

  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

  • Restrict or inhibit any other user from using and enjoying the Communication Services.

  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.

  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.

  • Violate any applicable laws or regulations.

The Zen Shed has no obligation to monitor the Communication Services. However, The Zen Shed reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. The Zen Shed reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

The Zen Shed reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in The Zen Shed's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. The Zen Shed does not control or endorse the content, messages or information found in any Communication Service and, therefore, The Zen Shed specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorised The Zen Shed spokespersons, and their views do not necessarily reflect those of The Zen Shed.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

Materials Provided to The Zen Shed or Posted on The Zen Shed Website. 

The Zen Shed does not claim ownership of the materials you provide to The Zen Shed (including feedback and suggestions) or post, upload, input or submit to any The Zen Shed website or its associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting The Zen Shed, its affiliated companies and necessary sub-licensees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.

No compensation will be paid with respect to the use of your Submission, as provided herein. The Zen Shed is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in The Zen Shed's sole discretion.

Changes are periodically added to the information herein. The Zen Shed and/or its suppliers may make improvements and/or changes in The Zen Shed website at any time. Liability Waiver

Before practicing at The Zen Shed students are required to sign the liability waiver show in italics below.

You should obtain medical clearance from your health care practitioner prior to beginning any exercise program at The Zen Shed. The exercises and classes offered at the studio are not suitable for everyone and are not a substitute for medical expertise. If done improperly, exercise has some risk of injury. If you feel discomfort or pain, DO NOT continue.  

Voluntary Participation
I, the undersigned, acknowledge that I have voluntarily chosen and requested to participate in the yoga or exercise class, workshop, event, or activity sponsored by The Zen Shed.

Acknowledgment

I am aware that participation in the yoga or exercise class, workshop, event, or activity may be hazardous. I acknowledge that a certain minimum level of physical health, strength, fitness, and flexibility will be required. I represent that I possess the level of health, strength, fitness, and flexibility necessary to participate in these activities. I am voluntarily participating in these activities with knowledge of the risks of injury. I assume all responsibility and liability for any and all injuries I may sustain due to my participation in these activities.

Release
In consideration for being permitted to participate in the yoga or exercise class, workshop, event, or activity, I agree that I, my heirs, assignees, guardians, and legal representatives will not make any claim against, sue, or attach the property of, any of the hosts, instructors, organizers, or participants in the yoga or exercise class, workshop, event, or activity including but not limited to The Zen Shed, for injury or damage resulting from my participation in such yoga or exercise class, workshop, event, or activity. I release all such hosts, instructors, organizers, and participants, their agents and heirs, from any and all actions, causes of action, lawsuits, claims, or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter may have for any and all injury, illness, loss of or damage to property associated with my participation in the yoga or exercise class, workshop, event, or activity. I have carefully read this agreement and fully understand its contents. I am aware and agree that it is a complete release of liability for any injuries or damages I may sustain due to yoga or exercise classes, workshops, events, and activities with The Zen Shed and all such hosts, instructors, organizers, and participants.

Email Notifications
By entering in to this agreement, I agree to receive email notifications confirming information on my purchases, bookings, class reminders, pass expirations and cancellations.

Photography/Filming
We reserve the right to photograph or film during our classes and to use these images for our website and marketing purposes. By entering into this agreement I agree that it is my responsibility to make myself known should I not wish to be photographed or filmed.

Under 18s
If the account is for a person under the age of 18, I confirm that the contact details given are for someone over 18.

Membership Terms and Conditions 

Zen 4 Membership – Terms and Conditions

Zen 4 Membership allows you to attend up to 4 classes a month at The Zen Shed, other than Pregnancy and Post Natal yoga classes which are not covered by Zen 4 Membership. Any unused classes cannot be carried forward to the next month. The cost of a Zen 4 membership per month is reflected on the pricing page of our website.

This cost includes VAT, will be charged monthly to your debit or credit card.  Payments by direct debit are not accepted, but you may arrange to pay by monthly standing order upon request.

Zen 4 Membership has a minimum term of 3 months from the date of the first charge. 

After 3 months has elapsed the monthly charges will continue, until such time as you request a termination of the contract in writing. 

If you would like to terminate the contract a month's notice in writing is required, either by post to The Zen Shed at 54 New Street, Worcester, WR1 2DL or by e-Mail to thezenshed@gmail.com.  You should allow 3 days for us to receive any notification by post.  We will acknowledge receipt of your notification by letter or email as soon as we have it; if you do not receive such a confirmation within 3 Days of notifying us, you should contact us again to make sure the notification has been safely received.

After receipt of the notification by us, one further payment will be charged to your debit or credit card on the normal payment date, and you will be able to continue to enjoy the benefits of the membership for one month from that date. Subsequent payments will be cancelled.

Zen Full Membership – Terms and Conditions

Monthly Zen Full Membership allows you unlimited yoga at all Zen Shed classes, other than Pregnancy and Post Natal yoga classes which are not covered by Monthly Zen Membership.

The cost of a Zen Full Membership per month is reflected on the pricing page of our website.

This cost includes VAT, will be charged monthly to your debit or credit card.  Payments by direct debit are not accepted, but you may arrange to pay by monthly standing order upon request.

Monthly Zen Full Membership has a minimum term of 3 months from the date of the first charge.

After 3 months has elapsed the monthly charges will continue, until such time as you request a termination of the contract in writing.
